Virginia Beach Child Support Lawyers

Parents arguing over child support

When your children were born, you knew you would work to provide them with everything they could ever need. The truth of the matter is that many of the needs children have are costly. These needs include health care costs, education, food, clothing, and more. Virginia child support laws are meant to ensure that all children receive adequate financial support. The Court’s goal is to ensure that both parents are contributing and sharing the costs of raising the children they had together. Courts also recognize that child support obligations need to be fair and that they are to be used to care for children and not to support the other parent. Our Virginia Beach child support attorneys practice heavily in the area of family law. Contact our office today at (757) 422-4646.

Lawyers fighting for fair child support payments on behalf of Virginia residents

Virginia determines the amount of required child support by applying the “Virginia Child Support Guidelines.” Our state assumes that both parents will be “fairly sharing” the cost of raising their children and the guidelines provide a formula for estimating child support. Child support payments are based on the total income of both parents, the number of children the parents have together, the percentage that each parent contributes to the total income, and the child custody arrangement (sole custody, shared custody, split custody, etc.) that is decided upon by the Court. It is presumed by the Court that the amount of support recommended by the guidelines is correct and fair to both parents. However, in certain cases, a child support payment amount may not be fair to one or both parents due to unusual circumstances. Having an attorney who can effectively argue for a fair child support amount can make the difference in how the Judge rules.

Our family law attorneys are experienced in helping Virginians navigate the child support system. We will use the discovery process to establish what, in fact, one’s income and expenses actually are. This can be accomplished by obtaining pay stubs, bank records, billing statements, and other financial documents. Once one’s income and expenses are established, we can challenge child support guidelines when a situation warrants deviation from the norm. Situations in which the court will consider allowing a change from the guidelines include:

  • one parent providing support to other family members
  • custody arrangements that include costly visitation and travel expenses
  • if one parent is voluntarily unemployed or underemployed
  • when debts are incurred for the child’s benefit
  • any special needs of a child
  • a child’s standard of living during a prior marriage between the parents

Our attorneys understand what factual evidence the Court analyzes when deciding whether or not a parent’s situation truly warrants a deviation from the standard formula. We are skilled at presenting to the Court an articulate and well defended presentation of your situation. Call now for a free consultation.
